Trying to make nvidia legacy on Thinkpad t61p

The Nvidia legacy diver make install is complaining about sys/capability.h being deprecated. Is there a way to overcome this?

I attached a screenshot. Thanks.

It turns out that there WAS a binary driver for the legacy card and I did not know it. So, no need to get one from Nvidia and try to install that. It was the 340 port. Once I installed that it was esay to get the rest working.
 
Alll the nvidia drivers in the ports tree and packages are the same drivers you get from the NVidia website.

I was a bit confused there for a sec but I'm glad they ended up being there because now it's running (Austin Powers voice) "Sound as a Pound". Yeah baby.
